Important Changes to Fair Hearing Rights
Beginning May 1, 2018, we will see a major change related to appeals and fair hearing rights affecting Medicaid Managed Care enrollees. To dispute a plan’s adverse determination (ie. denials, reductions, or inadequacy), enrollees must "exhaust" the plan’s internal appeal process BEFORE requesting a fair hearing. 42 C.F.R. 438.402(c) How to Request an Internal Appeal
What is Medicaid?
What is Medicaid? Medicaid is a state and federally funded program that provides Health Insurance to low income individuals in New York State. There are TWO types of Medicaid. They are called MAGI and Non-MAGI. MAGI stands for the Modified Adjusted Gross Income category. Non-MAGI just means that someone doesn’t qualify for MAGI Medicaid. We’ll talk about the differences more below.   You may have a choice between MAGI or Non-MAGI Medicaid.

LawNY launched the Consumer Law Project on December 1, 2017. Our Consumer Hotline provides callers with basic information and pro se resources on different topics such as: credit reports, debt collection, scams, student loans, identity theft, vehicle repossession, lemon law issues, and more.
What is Medicare?
Medicare is a federally funded program which provides health and hospital insurance benefits. Generally people can receive Medicare if: They are 65 years or older. They receive Social Security Disability They suffer from end stage renal disease. They are diagnosed with ALS. ALS is also known as Lou Gehrig ’s disease. Recipients of Railroad Retirement benefits. Unlike Medicaid, receiving Medicare is not based on an individual’s income or assets. What types of Medicare are there?
Legal Assistance of Western New York, Inc. Receives $264,904 Pro Bono Innovation Fund Grant
WASHINGTON – The Legal Services Corporation (LSC) announced today that Legal Assistance of Western New York, Inc. will receive a $264,904 Pro Bono Innovation Fund grant. LSC’s Pro Bono Innovation Fund is intended to encourage and expand robust pro bono efforts and partnerships to serve more low-income clients.
LawNY 50th Anniversary Celebration
  On September 27th, LawNY celebrated its 50th Anniversary with a dinner that brought together friends, alumni, staff, donors and community partners to reconnect and reminisce. We also listened to powerful testimonies from former clients that highlighted both the legal needs in our community as well as the positive impact of civil legal services. LawNY would like to personally thank these individuals for their bravery and strength in sharing their stories with us.   We were also honored that Tim Curtin from the Law Department of the City of Rochester provided a proclamation on behalf of Mayor Lovely Warren and the City of Rochester. In addition, we acknowledged proclamations from Assemblyman Gantt, Assemblyman Morelle, and State Senator Rich Funke. Another memorable part of the evening was the announcement that County Executive Cheryl Dinolfo had declared September 27, 2018, to be “Legal Assistance of Western New York Day.” We were also extremely grateful that honored guests, including County Legislator Michael Lausell, Honorable Joan Kohout, Honorable Ellen Yacknin, Administrative Law Judge John Costello, Administrative Law Judge Brian Kane, and Kevin Beckford from the Pittsford Town Board, were able to take time to celebrate with us.   We also recognized two organizations whose collaboration and vision created what is now the Rochester office of LawNY (formerly the Monroe County Bar Association’s Legal Assistance Corporation). LawNY Deputy Director Lori O’Brien presented Community Partner Awards to Kevin Ryan, Executive Director of the Monroe County Bar Association (MCBA), and Jerome Underwood, President and CEO of Action for a Better Community (ABC). These awards celebrated their organizations’ invaluable contributions to our formation in the late 1960s.   In addition, board members Richard Curtis and Mollie Dapolito presented a surprise award to Ken Perri, LawNY’s Executive Director. Ken’s strong leadership, dedication, and hard work has shaped LawNY into a force for good in our communities.     In honor of our 50th Anniversary, it was announced at the dinner that the Glover-Crask Foundation generously offered to match up to $5,000 worth of donations. We are on our way to that goal.
